The failure of cultural institutions on a mass scale is akin to extinction of a dominant genus/species. What emerges and dominates in the natural world are species adapted to the new/changed environment. Reactionaries would say the same for culture, which fits nicely with their tendency to power worship. But I don’t think natural selection functions to the same extent or the same way in human affairs. In retrospect, the emergence of the militant right, orchestrated by the rich, in the wake of the 2008 collapse and the election of Obama was nicely calculated to prevent a reemergence of New Deal type progressivism. It was planned. And it has worked — but is probably not sustainable given the ongoing systemic collapse. What counter-plans (and, more important, execution) should be made?

Right on.
I would add that since law is always in flux, and since part of a lawyer’s job (in any professional context I can think of) is to anticipate the ways in which the law might move, both knowledge of legal history and a sense of how legal change has taken place in the past are essential skills for the excellent lawyer.

The GOP is in a box on immigration, ultimately their position is untenable but too many of their stalwarts won’t support it. “Path to citizenship,” or “amnesty,” is the hang up, but it seems like it’s always something isn’t it?

It’s interesting that their message and strategy coming from Congress is more or less exactly the same while trying not to talk about immigration. I would have needed a drink of water too if I had been trying to walk that razor’s edge.

I was just thinking yesterday about how statistical information (even when produced using reliable methodology) is not very useful. Because it never “tells the whole story.” In order to tell “the story,” which is always what people are interested in, you really need to tell a story.

Fodder for our meal but you’re missing the big story — if the R’s can’t win with the reality they face now, then they’ll change it. Defund the dems by throttling the trial lawyers and labor unions. Deissue them by getting a grand deal on entitlements. Change the rules of the electoral college so that in Dem leaning states for Prez that are controlled by R’s in the legislature and Govs mansion at the moment (think MI, PA, etc.) EC votes are allocated on a Cong. dist basis (think NE and ME). Supress the Dem vote through voter intimidating laws and underfunding the voting apparatus, etc.

If you can’t win, change the rules until you can — and they are doing just that pretty successfully.
